The family is the backbone of the society. The Constitution of Kenya acknowledges that the family is the natural and fundamental unit of the society and the necessary basis of social order. Laws have therefore been put in place to protect all spheres of the family. They include the Constitution itself, Law of Succession, Marriage Act 2014, The Children Act 2022, The Matrimonial Property Act 2013 and Protection Against Domestic Violence Act 2015. Although the laws have been put in place, disputes still do occur within a family (between husbands and wives, parents and children, between siblings, or with extended families (grandparents, aunts, uncles, etc.). Cases of domestic violence continue being reported every day in Kenya. Retrogressive cultural practices, illiteracy and socioeconomic status are some of the factors that have contributed to the consistent rise of domestic violence cases in Kenya.

Family Disputes

Although many family disputes are usually referred to court, mediation is now widely acknowledged as the best dispute resolution technique in family disputes. Due to the emotional nature of most family disputes, mediation provides an environment where delicate issues can be resolved harmoniously while focusing on all the parties interests.
The judiciary in Kenya has continued to promote mediation through the Court Annexed Mediation (CAM), which was first implemented in Kenya in April 2016 at the Commercial and Family Divisions of the Court.
